Here’s a thought-provoking case. I baby was found abandoned in a Tennessee Park. The child is fine, thank goodness, but there is a question of how old it is. If an abandoned baby is found to be over the 72- hour age limit stipulated by most state laws, the child will still be cared for, but the parent who abandoned them faces criminal prosecution. In this case, of course, the child was abandoned in a park, which is not covered by Safe Haven Laws at all. Yet, if a 4-day-old child had been dropped off anonymously at a hospital, there is still some gray area as to whether the parent is in trouble with the law.
There are other circumstances that have to be considered. Perhaps the baby was given up under duress, perhaps the baby was kidnapped, or perhaps the parent has become physically incapable of caring for the child. Most parents who choose not to follow the law absolutely should be charged, but not every case is black and white.
